France postponed its new professional packaging levy to 1 January 2027 on 28 July: the government's stated reason wasn't the regulation, it was that nobody could say which companies were actually liable

What the 28 July announcement actually changes

France has run an EPR scheme for household packaging since 1992, financed mainly through Citeo: the green dot logic most brands already know. Décret n° 2025-1081, published in the Journal officiel on 17 November 2025, created a separate, new filière for packaging that is consumed or used by professionals rather than households: drums, jerry cans, big bags, crates and professional-format containers, covering sectors from FMCG and pharma to aerospace and food service, with no revenue threshold for the companies placing them on the market. The decree, and a companion arrêté defining the exact scope on 2 December 2025, set the scheme's operational start for 1 July 2026. On 5 June 2026, less than four weeks before that date, the state approved three eco-organismes to actually run it: Citeo Pro, Léko Pro and Twiice. On 28 July 2026, the government confirmed what that late approval already implied: the administration had not finished the underlying classification work of confirming which companies were liable, so it moved the operational start date to 1 January 2027, gave eco-organismes until September 2026 to publish 2027 tariffs, and gave liable companies until 31 December 2026 to register with one.

The numbers behind the postponement

One number is how far the operational date actually moved. One is how many eco-organismes exist to receive the registrations everyone is now racing toward. One is the threshold below which a company is exempt, which is not a small number, it is none at all.

The real subject: a regulation delayed by a classification gap, not a drafting one

Most EPR postponements get attributed to industry lobbying, court challenges, or a government simply running out of drafting time. This one is different, and the government said so itself: the text of Décret n° 2025-1081 was finished, the scope arrêté was finished, and three eco-organismes were even approved and ready to collect. What wasn't finished was the far more basic task of mapping the population of companies the rule was supposed to apply to against the actual definition of "professional packaging" the arrêté had set. That gap is exactly why eco-organismes could not publish credible 2026 tariffs in time, because a tariff only means something once you know roughly how many liable companies and how much packaging tonnage it has to spread across. Read this as "France pushed back an environmental deadline," and it looks like routine bureaucratic friction. Read it as "a national regulator tried to launch a compliance obligation before it had finished classifying who the obligation covered, and had to stop," and it becomes a specific, structural failure: the state itself hit the same product-and-company classification problem that any individual brand hits when a new packaging rule lands and nobody has mapped which SKUs, which formats and which entities are actually in scope.

Why it matters for brands

Any retail, consumer-goods or luxury brand that ships product into or within France in bulk, wholesale or professional-format packaging, not just the retail-ready packaging consumers see, now has a live but easy-to-miss compliance line separate from its existing Citeo household packaging registration. The postponement did not remove the obligation, it moved the deadline to 31 December 2026 for registering with Citeo Pro, Léko Pro or Twiice, ahead of the scheme going live on 1 January 2027, and it gave companies a narrow window (eco-organismes are due to publish 2027 tariffs from September 2026) to actually see what the new eco-contribution will cost before it is due. A brand that treats "packaging compliance in France" as a single, already-solved Citeo relationship risks discovering in Q1 2027 that its B2B shipping formats, distribution packaging or wholesale containers were never registered anywhere. Brands that hold packaging data as structured, per-format, per-market records, which packaging is retail-facing versus professional-use, which entity places it on the French market, which eco-organisme it should register with, can move the moment scope is confirmed. Brands relying on a single undifferentiated packaging compliance file inherit exactly the classification gap that just forced the French state itself to delay its own regulation.
